Terms of Use

Attorney, News Media, & Law Enforcement Access to Current Inmate Information

1. Purpose and Scope

This Terms of Use (“Terms”) governs access to and use of the Current Inmate Information System (“System”) provided by The Floyd County Sheriff’s Office Access is granted solely to verified attorneys, news media personnel, & law enforcement for lawful, professional, and ethical purposes.

By accessing or using this System, you acknowledge that you have read, understood, and agree to comply with these Terms and all applicable federal and state laws.

2. Authorized Users

Access to the System is limited to:

  • Licensed attorneys acting in a professional legal capacity; and

  • Verified members of the news media acting in a legitimate newsgathering capacity.

  • Law Enforcement personnel.

Access may be revoked at any time for misuse, misrepresentation, or violation of these Terms.

3. Booking Photographs (Mugshots)

3.1 Definition

A “booking photograph” is a photograph or image of an individual taken by a law enforcement agency for identification purposes or during the booking process into a detention facility.

3.2 Restrictions on Use and Distribution

Except as otherwise permitted by law:

  • Booking photographs are not authorized for public posting directly by law enforcement agencies on websites or in publications.

  • Booking photographs may not be requested, obtained, shared, published, or transferred if they will be used in any manner that requires payment or other consideration for removal or deletion from a publication or website.

3.3 Certification of Compliance

Any request for a booking photograph must include an affirmation that the photograph will be used in compliance with applicable law.
Knowingly making a false statement in connection with a request for a booking photograph may constitute a criminal offense under applicable law.

4. Mandatory Removal of Booking Photographs (No Charge)

Websites, publishers, or media entities in possession of a booking photograph must remove the photograph at no charge upon receipt of a written request accompanied by appropriate documentation demonstrating that the individual’s case meets one of the following conditions (a waiting period may apply where permitted by law):

  • Charges Dropped, Dismissed, or Acquittal
    If all charges were dismissed, dropped, or resulted in an acquittal.

  • Record Restriction
    If the arrest record is eligible for and has been restricted pursuant to O.C.G.A. § 35-3-37.

  • First Offender Status
    If the individual qualified for First Offender status and successfully completed the terms of the sentence.

  • Certain Drug or Probation-Related Dispositions
    Where applicable law requires removal based on qualifying drug offenses or probation outcomes.

  • No Conviction
    If the individual was not convicted of any criminal offense arising from the incident.

Failure to remove booking photographs under these circumstances may constitute a violation of applicable law.

5. Prohibited Information

The following information is confidential and shall not be accessed, released, published, or disseminated through the System:

  • Medical or mental health information

  • Juvenile-related information or offenses

  • Information concerning victims of a crime, unless expressly stated in a public indictment

  • Names, addresses, or identifying information of an inmate’s or employee’s family members

  • An inmate’s institutional or classification file in its entirety

Unauthorized access to or disclosure of this information is strictly prohibited.

6. Permitted Use

Information obtained through the System may be used solely for:

  • Legitimate legal representation

  • Accurate, lawful, and ethical news reporting

  • Other purposes expressly authorized by law

Use of information for harassment, intimidation, commercial exploitation, or any improper purpose is prohibited.

7. Accuracy and Disclaimer

Inmate information is subject to change and may not reflect real-time updates. The Floyd County Sheriff’s Office makes no guarantees regarding the accuracy, completeness, or timeliness of the information and assumes no liability for reliance on the data provided.

8. Monitoring, Enforcement, and Penalties

Use of the System may be monitored and logged. Violations of these Terms may result in:

  • Immediate suspension or termination of access

  • Administrative action

  • Referral for civil or criminal enforcement, where applicable

9. Acceptance of Terms

By accessing this System, you affirm that you are an authorized user and agree to comply with these Terms and all applicable laws. Misuse of the System may result in loss of access and legal consequences.
